FENSA LOGO MISUSE PROSECUTION

Bright Windows UK Ltd of Willesden, London, NW10, was successfully prosecuted by Trading Standards for misuse of the FENSA logo.  The case was reported in the local newspaper, the Kilburn & Brent Times.  It cost the company and its owners over £7,000 in fines and costs.

FENSA was informed of the logo misuse through www.cowboystoppers.co.uk<http://www.cowboystoppers.co.uk> – a website set up by FENSA exactly for this purpose.  The email received contained a link to the Bright Windows website where the FENSA logo was displayed.  This was the evidence required to start an investigation.

The FENSA operations team wrote to the London Borough of Brent and Harrow Trading Standards Service to inform them of this misuse of the FENSA logo.  FENSA was asked for a Witness Statement by Trading Standards under the Criminal Justice Act 1967 and Magistrates’ Courts Act 1980.  This was supplied in October 2014.

“FENSA was pleased to assist in any way possible,” commented FENSA Operations Manager Mary Hewitt.  “We looked through our records to check the status of any FENSA registration for this company and advised the Court that Bright Windows were not with FENSA.  This was the basis of the Witness Statement.”

FENSA is happy to receive any information about suspected misuse of the FENSA logo or name from anyone in the industry and from any members of the public.  This information must be accompanied by images of the misuse, and this can include reference to the offending company’s website if the logo misuse appears there.

FENSA has a defined process it follows once logo misuse has been satisfactorily identified.  This will include informing the local Trading Standards office so that they can proceed with a prosecution.
